Yachtiecareers.com, LCC. (“YC”) provides our website located at www.Yachtiecareers.com (the “Site”) and our services accessible via our Site. To make these Terms easier to read, the Site, our services are collectively called the “Services.” Please read these Terms of Service (the “Terms”) carefully because they govern your use of our Services.
Agreement to Terms
By using our Services, you agree to be bound by these Terms. If you don’t agree to be bound by these Terms, do not use the Services.
Confidentiality
All secret or other confidential information relating to the business of the Client, its employees, transactions or finances disclosed by the Client to the Employment Business in confidence shall not otherwise than in connection with the affairs of the Client be passed on to a third party by the Employment Business or in any way improperly used by the Employment Business at any time during or after the termination of this Assignment. All details will be treated as per client’s requests and instructions.
Changes to Terms or Services
We may modify the Terms at any time, in our sole discretion. If we do so, we’ll let you know either by posting the modified Terms on the Site or through other communications. It’s important that you review the Terms whenever we modify them because if you continue to use the Services after we have posted modified Terms on the Site, you are indicating to us that you agree to be bound by the modified Terms. If you don’t agree to be bound by the modified Terms, then you may not use the Services anymore. Because our Services are evolving over time we may change or discontinue all or any part of the Services, at any time and without notice, at our sole discretion.
Who May Use the Services
Eligibility
You may use the Services only if you are 16 years or older and are not barred from using the Services under applicable law. To make a purchase via the Services (described in the Section titled “Purchases” below), you must be 18 years or older and capable of forming a binding contract.
Applicable Law
Please note that these terms of use, its subject matter and its formation, are governed by US law. You and we both agree to that the courts of US will have non-exclusive jurisdiction.
Privacy Policy
Please refer to our Privacy Policy for information on how we collect, use and disclose information from our users. You acknowledge and agree that your use of the Services is subject to our Privacy Policy.
Limitations of Liability
Nothing in these terms of use excludes or limits our liability for death or personal injury arising from our negligence, or our fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by US law.
To the extent permitted by law, we exclude all conditions, warranties, representations or other terms which may apply to our site or any content on it, whether express or implied.
We will not be liable to any user for any loss or damage, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, even if foreseeable, arising under or in connection with:
- use of, or inability to use, our site; or
use of or reliance on any content displayed on our site.
Yachtiecareers LLC have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.
ADMISSION POLICY
YachtieCareers, LLC admits students of any race, nationality, and ethnic origin to all rights, privileges, programs, and activities generally accorded or made available to the students at our training programme.
LEAVE, ABSENCE
After the training course commencement if for some reason the student is late or absent from class or a scheduled session due to illness, emergency, called to work, or any other reason Yachtiecareers , LLC must be notified immediately of your status.
GROUNDS FOR TERMINATION
Grounds for termination shall be for non-payment of as per Payment Plan conditions or improper conduct, absenteeism without notification, or unsatisfactory attendance. Improper conduct, which in the opinion of the instructor or training staffs detrimental to the learning process of the other students.
REFUND POLICY
Deposits are Non-Refundable.
The deposit and first payment to start the programme are non-refundable. If for any reason Yachtiecareers, LLC cancels a training date all other amounts will be refunded to you, or you may use them at a different training date.
(Student is responsible to maintain proof of payment, check or Agreement receipt.) Refunds will be not be granted once course commences.
CERTIFICATION OF TRAINING OR COMPLETION
USA
Certificate of Training or Completion are to be submitted in accordance with the applicable Coast Guard rule. Gulf Coast Maritime Academy will maintain records of all students completing the course for a period of 5 years from the date of course completion and cannot be duplicate certificates after that time frame.
Refunds
In the event that you can not attend or want to cancel, we will not charge you the remaining payments. You will only be charged the initial deposit and the 2nd payment will not be charged to the customer.
When using the code paylater50 the customers agree to pay 50% off the price and gets access to the full training programme. This amount cannot be refunded.
After completing the STCW Basic Safety Training and modules online refund can not be issued. Any refund has to be requested maximum 7 days after payment date.
CROATIA
Course certificates are available to pick up the training centre in Split (SSM LTD) at the end of the course. After the final exam your original STCW Basic Safety certificate will be issued and sent to your address as well as a digital copy email to you with the certificate number. The validity of certificate can be confirmed and checked with the Croatian maritime authority and is valid worldwide.
END-OF-COURSE ASSESMENT
You will be required to take and end of course examination(s) and attend all practical training and assessment sessions as scheduled. The fee has to be paid to the Croatian maritime Authority before the exam.
PRACITCAL TRAINING AND ASSESMENTS
Certain training courses require demonstration by the student of proficiency (i.e. performing in-water survival techniques, firefighting procedures, etc.). Should the student refuse to voluntarily perform any required training procedures or demonstrations of proficiency, it will be considered a course failure.
COURSE FAILURE
If for some reason, you cannot successfully pass the applicable end-of-course written examination(s) (In most courses you are allowed 3 attempts on written examinations) or cannot successfully demonstrate proficiency according to the minimum criteria for the course, it will be considered a course failure.
YachtieCareers LLC IS NOT RESPONSIBLE FOR ANY TRAVEL FEES IF A COURSE IS RESCHEDULED OR CANCELLED FOR ANY REASON. ALL TRAVEL EXPENSES ARE THE RESPONSIBILITY OF THE STUDENT.
Your Personal Details
If you choose, or you are provided with, a user identification code, password or any other piece of information as part of our security procedures, you must treat such information as confidential. You must not disclose it to any third party.
We have the right to disable any user identification code or password, whether chosen by you or allocated by us, at any time, if in our reasonable opinion you have failed to comply with any of the provisions of these terms of use.
Content providers
We provide access for visitors to its sites to post material, resumes, references, photographs and other content. By uploading any personally identifiable information you are providing consent for us to store and process your personal data outside the EU for the purpose of completing a contract between you and the company.
This content is provided by outside sources and is not warranted as correct, accurate or valid in any way by Yachtiecareers LLC.
YachtieCareers LLC does not and cannot review all communications and materials posted to or created by users accessing our site and is not in any manner responsible for the content of these communications and materials. We reserves the right, however, to block or remove communications or materials that it determines to be (a) abusive, defamatory, or obscene, (c) in violation of a copyright, trademark or other intellectual property right of another, or (d) offensive or otherwise unacceptable to YachtieCareers LLC in its sole discretion.

“YachtieCareers LLC” works with partners to organize courses and training. We do not assume liability for the change or content on products purchased outside our website. For all products purchased or used by our directed partners, the terms & conditions for that partner will apply.

Bookings
When booking you can select a split payment with a first deposit of 50%. This gives you access to the full training programme, and access to all courses available through your Dashboard.
The rest of the payment is to be paid before the start of the STCW Training week in Florida or Croatia.
Payment Plans
To access a split payment plans the code: “paylater50” has to be used at checkout. When using the code and a payment plan the remaining and full amount at all times has to be paid in full before the start date of the booked STCW Basic Safety Training in (Croatia or Florida).
The first payment giving you full access to all training except the STCW Week is non-refundable.
Refunds
In the event that you can not attend or want to cancel, we will not charge you the remaining payments. You will only be charged the initial deposit and the 2nd payment will not be charged to the customer.

Full Payment
The full payment as per the payment plan is due before/at the start of the STCW training week.
The customer has no right to attend the STCW Basic Safety training with Yachtiecareers and/or its partners until the full payment has been paid.
If you need to change your date, we will not charge you the second payment until your new STCW Date.
Yachtiecareers reserves the rights to change price plans and products without notice.
Recruitment
Our services include a completely free crew recruitment section. Users and applicants will never be charged fees for using YachtieCareers recruitment services and job search. This service is free for all users, crew and yacht clients.
A Yacht job is not guaranteed. Depending on the current industry demands, season the time to get a job varies. Although Yachtiecareers assist in the job search, the student have to follow the plan and do their own Job Applications. Our plan focuses to have all training and CV completed within 6 weeks so that you can successfully start the job search plan.
Flexible Dates
If you want to change your STCW Training date, you can do so free of charge, just let YachtieCareers know by email to [email protected] at least 14 days before the training and the change will be free of charge to the customer.

Third Parties
No provision of this Agreement shall be enforceable by any person who is not a party to it pursuant to the Contract (Rights of Third Parties) Act 1999 (“the Act”). This does not, however, affect any right or remedy of a third party that exists or is available independently of the Act.
Standards Required
The Client agrees to provide to the Employment Business sufficient information to enable the Employment Business to confirm the suitability of the candidate for the Assignment. In this regard, the Client agrees to provide at least the following information:
(a) the duration, or likely duration, of the Assignment;
(b) the nature of the business and the position, the type of work the Temporary Worker would be required to do, the location at which and the hours during which he or she would be required to work;
(c) any risks to health or safety relevant to the Assignment and known to the Client, and what steps the Client has taken to prevent or control such risks and by instructing the Employment Business to provide the Temporary Worker, the Client confirms that it has carried out a thorough risk assessment of the place(s) of work relating to the
Assignment unless it has otherwise notified the Employment Business; and
(d) the experience, training, qualifications and any authorisation which the Client considers are necessary, or which are required by law or by any professional body, for the Temporary Worker to possess in order to work in the position, and any expenses payable by or to the Temporary Worker.
The Client agrees to notify the Employment Business of the above information:
(a) in good time before the commencement of the Assignment; and
(b) without delay during the Assignment, where appropriate (for example, in the light of a change of circumstances).
