Terms of Use YCA Media Limited Liability Company (“YCA Media“, “YCA” ,”YachtieCareers” ,”we“, “us“, “our“), Registered at 1309 Coffeen Avenue STE 1200, Sheridan, WY, US. By using our services, website, portals and purchasing any product you will adhere to all terms and conditions below:

Yachtiecareers.com, (“YCA”, “YachtieCareers”) provides our website located at www.Yachtiecareers.com (the “Site”) and our services accessible via our Site. To make these Terms easier to read, the Site, our services are collectively called the “Services.” Please read these Terms of Service (the “Terms”) carefully because they govern your use of our Services. For any services, products and other items purchased through the domain www.yachtiecareers.com or any other products affiliated to this website you agree to the terms and conditions outlined below.

Restrictions

You are not authorized to copy or use any information, products, templates, documents or videos associated with YachtieCareers Website, logos or any of the sources associated with https://yachtcrewtraining.yachtiecareers.com

Agreement to Terms

By using our Services, you agree to be bound by these Terms. If you don’t agree to be bound by these Terms, do not use the Services.

Changes to Terms or Services

We may modify the Terms at any time, in our sole discretion. If we do so, we’ll let you know either by posting the modified Terms on the Site or through other communications. It’s important that you review the Terms whenever we modify them because if you continue to use the Services after we have posted modified Terms on the Site, you are indicating to us that you agree to be bound by the modified Terms. If you don’t agree to be bound by the modified Terms, then you may not use the Services anymore. Because our Services are evolving over time we may change or discontinue all or any part of the Services, at any time and without notice, at our sole discretion.

Confidentiality

All communication and information or other confidential information relating to the business and training should not be shared to a third party for any economical or other advantages.

User Requirements

To use the services and training you acknowledge you are responsible to have and need the following to use the services.

It is your responsibility to arrange any flights, visas or other travel requirements to and from the training courses provided. You must have a valid ID and Passport. To use the services you must have a Computer, access to internet, whatsapp and an email account. You are responsible to read through all messages and information sent to you.
You are responsible for completing all courses on https://yachtcrewtraining.yachtiecareers.com/ and understand the information and your responsibilities of having all certificates and documents on board for your job.

Admission Policy

You may use the Services only if you are 16 years or older and are not barred from using the Services under applicable law.

Limitations of Liability

We are not liable for any user loss, damage, personal injury or death coming from using the services. We are not liable for any associated travel costs and expenses associated with using the services or attending the training.

To the extent permitted by law, we exclude all conditions, warranties, representations or other terms which may apply to our site or any content on it, whether express or implied.

YachtieCareers facilitates the training through third party training providers and centers. All enrolment with third parties, or any disputes with the training provided by a third partner must be resolved directly with that entity and YachtieCareers cannot be held liable for any indiscretion in the service or training provided by the third party.

Leave of Absence

All Training that we or international standards of training and STCW regulations deem have a mandatory presence by the student in person, you must adhere to the schedule of those courses and fully attend. If you are not able to attend for any reason you must state the reason in writing to [email protected]

Once notified of your status, YachtieCareers will do its best to facilitate or give you another training opportunity at our sole discretion. If we deem your presence have been unsatisfactory, we reserve the right to terminate your training and/or not issue the relevant certificates.

Refunds

The initial and first payment to any account associated with YachtieCareers is not refundable.

This first payment could be in form of a course deposit, full payment, or use of a payment plan by using applicable published coupon codes on the website. At no time is the first payment refundable, due to the fact of associated maintenance and course costs for YachtieCareers.

From the moment you get issued your payment receipt and/or log in details to access your dashboard and training provided through YachtieCareers portals the payment cannot be refunded.

Any refund request most be completed in writing by email to [email protected] before the start of the training week. Once starting STCW Basic Safety and/or having completed the STCW Basic Training week you agree that you have no right to any refund and no refund requests will be considered. Definition of starting STCW Basic Safety means starting any course with the abbreviation STCW.

After completing the training week and getting sent your D2 Basic Safety Certificate to designated email you waive any right or consideration to a refund.

Payment Plans

You may Split your course programme payments in 2 payments. This will constitute of only paying 50% on the first payment. You can use the payment Plan by using the code paylater50 at checkout using the website:www.yachtiecareers.com

The first payment will give you access to the training portals and serve as a deposit to guarantee your spot at the selected STCW Basic Safety Training date.

The full and final Payment has to be paid to the account or link provided by Yachtiecareers, and it must be completed 7 days before the start of the training date selected. Failure to complete the payment plan will give YachtieCareers the right to terminate your training and you will not be eligible to continue with the STCW Basic Safety training with our Training partners with access to our Yacht Training and services for CV, recruitment, On board training, dockwalking and other services specified on the website booking link used.

Discount codes

When using a discount code, it is for one-time use, and only 1 (one) discount code may be used per purchase and it is only valid on the first payment. The second payment as per the payment plan has to be paid in full as 50% of the original price booked.

Change of Date

We understand your plans can change and If you wish to change your training date you may do so by writing to [email protected] not later than 2 weeks before the start of your selected STCW Training Date.

If you do so we can transfer you to a different training date at our discretion with no additional fees incurred to you.

In this case your second payment as per payment plan used will be transferable and due 7 days before the new training date. YachtieCareers is not responsible for travel fees to and from the training.

Your Personal Details

If you choose, or you are provided with, a user identification code, password or any other piece of information as part of our security procedures, you must treat such information as confidential. You must not disclose it to any third party.

We have the right to disable any user identification code or password, whether chosen by you or allocated by us, at any time, if in our reasonable opinion you have failed to comply with any of the provisions of these terms of use.

All dates are preliminary and YachtieCareers reserves the right to change the date of training. If doing so you will be notified by registered email at least 14 days before the initial training date.

When sharing personal data, You also agree to share your details through google sheets for Doctors appointments through sharable files.

Online Training

Online training provided by Yachtiecareers is labelled YCA and constitutes of in house learning and course completion certification through https://yachtcrewtraining.yachtiecareers.com

Products

For any products or services purchased through the YachtieCareers website we reserve the right to change or update the content of those training services.

All photos on the website and social media associated are for illustrator purposes only.

Definitions of items included in booked Training.

STCW Basic Safety Personal Survival Techniques (PST) Fire Prevention and Firefighting (FPFF) Elementary First Aid (EFA) Personal Safety and Social Responsibility (PSSR) as per STCW code. Upon completion you will receive a course certificate for each module at the final day of training week.

And Additional STCW Basic Safety COC issued by Croatian Ministry will be sent to your email 7-30 days after completing the Exam. A physical copy can be shipped to your address on request. The certificates have a 5 year renewal period.

Final Exam Fee – Refers to 65€ payable to Croatian Ministry for exam fee. This is included in Premium package. Also one passport size photo must be submitted. Failure to do so makes you ineligible for the STCW Exam.

Food Hygiene Level 2 – Refers to Food Hygiene level 2 CPD accepted training as per standard EU regulation through any partner selected by us that.

Medical Certificate (ENG1/MLC) Refers to a Seafarers Medical Certificate issued by the examining doctor selected by us and is valid for a period of 2 years. The certificate is ENG1 or ENG1 equivalent as per standards set for medical certificate by MLC/STCW compliance code.

ISPS Security Awareness / PDSD (MCA) – Refers to PDSD, or Proficiency in Designated Security Duties, is a mandatory training course for seafarers with designated security duties on ships required to comply with the ISPS Code. It is issued by a selected training provider accepted by MCA.

Stewardess YCA Online Modules – Refers to in house online training guides that you get access to online within 48 hours of booking the course and can access with log in and password issued. These courses are in constant development and can be changed as per our requirements.

Deckhand YCA Online Modules – Refers to in house online training guides that you get access to online within 48 hours of booking the course and can access with log in and password issued. These courses are in constant development and can be changed as per our requirements.

Stewardess On board Training Day – Refers to a training day on board a small yacht selected by us at least 13m in length. The tasks, duties and training during this familiarization is at the discretion set by the instructor which will have experience in a Yacht Stewardess or Yacht Chief Stewardess role. The duration of the training can vary depending weather conditions, group size and Instructors requirements.

Deckhand On board Training Day – Refers to a training day on board a small yacht selected by us at least 13m in length. The tasks, duties and training during this familiarization is at the discretion set by the instructor which will have experience in a Yacht Deckhand or Yacht Chief role. The duration of the training can vary depending weather conditions, group size and Instructors requirements.

Online 18-Superyacht Courses – Refers to online modules in Introudction training, daywork guides, dock walking guides, job search guides and CV modules including Deckhand and Stewardess modules and STCW online certificates access modules to prepare you for the job search and role on board. You will be given access through log in details within 48 hours of booking the training. The online training modules are in constant development and subject to change to best prepare you for working on board.

Yacht CV – Yacht CV will be given in form of a template that we choose (Standard Package) or CV writing (Premium package). In order to receive CV service the following form has to be completed: https://yachtiecareers.com/cv-questions after the form is submitted the CV will be issued within 14 days or more.

Job Support – Refers to access to online tools and modules in Day working, Job search, agency lists, written reference letter upon training completion, on-site 1-1 consultation for CV and job search and the possibility to book a 1-1 call with a recruitment expert. Yachtie careers will at its own discretion offer roles through other contacts that we find suitable. Yachtie careers to not give or guarantee a job to any student and it is at our own discretion that we send your CV to a potential employer, if we at our own discretion believe you are qualified and suitable for the role. You can request help through designated WhatsApp or by email. We reserve the right to answer requests within 72 hours. During the training week period you have access to WhatsApp group and agree to receive information through this channel. The whatsapp group is to be used prior to the training week and during the training week. For personal support after the training week you agree to reach out designated email or personal whatsapp chat options.

Job Support (Premium) – Upon request we can help prepare for an interview and signing a contract. Upon request we can update your CV with new experience. Upon request we can do additional 1-1 consultations to offer you assistance in the job search upon booking the call through the links provided in your Dashboard. Yachtiecareers has no obligation to give you a job. We do not guarantee a yacht job. To remain in the job search pool it is important to send your latest CV and check in with location every 14 days.

Seamans Discharge book – Refers to us providing assistance in completing the form issued from your dashboard. You must follow the instructions and complete the necessary information. Upon requesting assistance to get a supporting letter to apply for the Seamans Discharge book you must provide your personal details, passport number and date of birth. The application fee to Cayman Island is payable by you and is not-refundable. The final decision for issuing the Seamans Discharge book is made by the Officer depending on a various of factors.

B1/B2 Visa – Refers to services and our help in providing a supporting letter for your visa appointment. You are responsible filling out the necessary forms, but can request assistance from us if required. We assume no liability or cost for a visa application being denied by the foreign embassy and can not be held accountable for any visa or travel restrictions. The application fee to the embassy is payable by you and is not-refundable. The final decision for issuing a Visa is made by the Officer at the embassy.

STCW Crowd & Crisis (Megayachts) – Refers to The STCW (International Convention on Standards of Training, Certification and Watchkeeping for Seafarers) Code mandates crowd management training for personnel on passenger ships. Specifically, this training is outlined in Section A-V/2, paragraph 1 & 2 of the STCW Code. This is an online course provided by our selected training partner.

Daywork Kit – Refers to 50 pieces of Business Cards issued within 14 days from the start of your booked training week date and a T-shirt in a size available in either the type Polo-shirt or standard Tee-shirt at our discretion given to you within 14 days from the start of your booked training week.

Dual Access to both Deckhand & Stewardess Programme – Refers to Stewardess YCA Online Modules – Refers to online training guides that you get access to online within 48 hours of booking the course and can access with log in and password issued. These courses are in constant development and can be changed as per our requirements.

Deckhand YCA Online Modules – Refers to online training guides that you get access to online within 48 hours of booking the course and can access with log in and password issued. These courses are in constant development and can be changed as per our requirements.

Upon request you may attend all above as long as you can make yourself available on the times and dates set by us.

Crew Accommodation Included – Refers to 7 nights included in a Crew Accommodation that we select for you that will be individual or shared with other students. It will be from 1 day before the selected training date for 7 nights.

We reserve the right to change the content of the course, training and website at any time without prior notice. All descriptions and illustrations on the website www.yachtiecaerers.com are for informational purposes only and subject to change. Any other service or product not outlined in these terms and conditions will be completed and offered at our sole discretion.

Certifications

Course learning certificates provided by YachtieCareers will be provided digitally. Issuing of STCW Certification and other certificates obtained through a third party training partner will be issued as per the terms and conditions of that training partner and by using the services of YachtieCareers and attending the training with the third party training partner selected you agree to the terms and rules for certification issue by the third party training partner. Certificates issued by national ministries are normally issued within 7-30 days after completing the final STCW Exam. We can not be held liable for any complications cause by post office or 3rd party training centre shipping of the national D2 certificate issued by the national ministry. We will send you a digital copy by your registered email with shipping instructions which has to be replied to in the correct format and sent to: [email protected]. It is your responsbility to respond to the email and get your certificate delivered to you and carry it together with all other necessary documents on board. It is your responsibility carrying all certificates and documents on board for your job.

Partners

YachtieCareers uses training partners for parts of your training and certification. Any training conducted with a third party training partner through YachtieCareers is as per the terms and conditions of that selected training partners and and dispute with the training provided with that training partners will have to be resolved with the training partner. YachtieCareers cannot be held liable for any training or certification provided from the used training partner.

Partnerships and 3rd Party.

YachtieCareers uses partnerships and all certification issued for STCW Basic Safety, ISPS, Food Hygiene and any other courses labelled STCW Courses will be organised and issued by a third party. Any matters or disputes relating to the courses provided by third parties through Yachtiecareers, Yachtiecareers can not be held accountable for.

Should the student have any dispute or seek compensation/refund for that part of the training it must be settled with the third party.
By using these services you accept these terms and you accept the right for YachtieCareers to select the training provider for you, and YachtieCareers will not have any liability for the training provided by that third party.

Affiliates may only use our links with our prior written consent and by YCA manually registering them as an affiliate. Commissions per order is the one provided in writing from email: [email protected]. The commission is capped at 100.00$US/order. If additional codes used it will be offset to the total order price.

Log in Details Programme conditions

When booking the training or services through YachtieCareers website: www.yachtiecareers.com we will issue a payment receipt as well as provide your log in details to your dashboard to access all the training no later than 48 hours after purchase.

CV Writing

For all products relating to CV writing services YachtieCareers will only write your CV when purchasing the training product labelled Premium Deckhand or Premium Stewardess. For all other products we will issue 2 CV templates and structure your CV for you.

For us to provide CV writing you agree to provide all necessary information by submitting the form published on www.yachtiecareers.com/cv-questions

Once submitted YachtieCareers guarantees delivery of your CV in digital form by the end of your selected STCW Basic Safety Training date with third partner or if you did not select a package with STCW Basic Safety Training included within 4 weeks of submission.

Visas

YachtieCareers reserves the right to add guidance to students enrolled in the programme to obtain the necessary Visas. We assume no liability or cost for a visa application being denied by the foreign embassy and can not be held accountable for any visa or travel restrictions.

Seamans Discharge Books

We provide students that purchase the Premium student training packages guidance and sending you the forms to complete a Seamans Discharge Book Application. We will sign it as a supporting agent. You will bear the cost for the application and YachtieCareers cannot be held accountable for an application being denied to the student.

T-shirt and Business Cards

We provide students that purchase the Premium student training packages. This will be given to you at our discretion either during the selected booking date for the STCW Basic Safety Training week with a Third Party or delivered to your home address. In order to receive the T-shirt and Business Cards you must provide YachtieCareers with a delivery address.

Premium Support 24/7 Support – Means that we will give you access to all portals and modules in your dashboard. We will write your CV and give you access to book 1-1 Consultation calls for the period of 1 year (365) days. We will also be available through WhatsApp within 48 hours and by email to answer your questions within 2-4 working days. Yacht jobs/Placement/Network

YachtieCareers, provides free Yacht Crew recruitment to all Yachts and employers as an incentive to promote junior crew and students. YachtieCareers is not an employer and can never guarantee employment. It is at the sole discretion of the employer if you will be employed for any job applications submitted individually or through YachtieCareers. The student should update Yachtiecareers with the Location and availability every 2 weeks and Yachtiecareers will also support with any help regarding signing a contract or preparing for an interview once such is scheduled with a potential employer.

Grounds for termination

Should you not attend mandatory training or not complete the ISPS modules with a third party within 6 months of enrollment you will bear the cost of extending the course access time. If you in anyway act in an abusive, disrespectful manner towards other students, course instructors or training staff we reserve the right to terminate your training with no refund issued.

Travel

All travel costs and expenses should be paid by the purchaser and YachtieCareers will not be liable for any travel costs or expenses for any reason.

Certification

YachtieCareers will provide course certification in form of digital course certificates downloadable from the student dashboards after completing the training from your student dashboard.

A third Party Training partner selected by YachtieCareers where you attend the advertised STCW training by that third party will issue course certification after completing the training by email and hard copy if requested.

Exam Fee

When attending the STCW Basic Safety Training with a third party in Croatia, there is an exam fee payable to the Croatian Ministry for attending the exam in order to get an endorsement certificate issued. This has to be paid by the student in person.

After successfully completing the Exam, the student will be emailed the endorsement STCW Certificate by the selected third-party training provider.

The third-party training provider will also give the option to deliver a hard copy of the certificate if the students provide the address in the email answer. For residential addresses outside of Europe the student will have to bear the cost of the shipment. For residential addresses within Europe, it will be free of charge.

End of Course Assessment

To get the STCW Basic Safety Course Certificate nationally endorsed by the Croatian Ministry for training in Croatia, you must successfully complete an exam.For any other STCW Basic Safety Training provided by a selected third party by YachtieCareers you must follow the terms and conditions of that training partner in order to get the certificate and endorsement issued.

Medical Certificate for Seafarers

In all Premium and Full STCW Deckhand and Stewardess packages YachtieCareers will arrange an appointment with a Medical Practioner and after successful examination with the Doctor the student will get issued a 2-year validity Medical Certificate as per MLC/STCW regulations.

Practical training and assessment

The parts described in the STCW code to be practical must be attended in order for certificate to be issued.

Accommodation

Students that select and purchase the Premium Training package will get 7 nights accommodation included in an establishment selected by YachtieCareers. Accommodation details will be sent to the student 7 days prior to commencement of STCW Basic Safety training. The standard form of accommodation will be in a 2-bed, 4-bed or 6-bed shared accommodation at Hostel Dalmatinac next to the STCW Training centre SSM.

Definitions

Third Party – Any training provider that is selected by YachtieCareers to provide parts of your training. When purchasing training you accept that YachtieCareers cannot be held liable for any of the training provided by third partners. These third-party training partners can change without notice.

Yacht onboard Training Day

Will be conducted as per weather conditions as a familiarisation for the duties on board explaining and doing a tour of practical elements you will be facing on board as a Deckhand or Stewardess. The time and day for this training will vary and details will be issued to students at least 48 hours before the training occasion. The assigned Deckhand or Stewardess carrying out the training will follow the curriculum set to the best of their ability and as per students requests. (As far as practicable).

STCW – All training labelled STCW is not provided directly through YachtieCareers but through a selected Training partner. Yachtiecareers is not accountable or cannot be held liable for any training provided labelled under the abbreviation STCW as we are not the ones providing the training.

ISPS – Courses labelled ISPS is also STCW courses provided by a selected third-party training partner and you must comply with course requirements and completion to get the certificate issued as per the terms and regulations of the selected training partner. This part of the training is provided online.

YCA – Is the in-house training offered by YachtieCareers through online guides and modules.

Student – Student is anyone who purchases or contacts Yachtiecareers to use our services and training.

Pricing and change of pricing

We reserve the right to change the price of any service or product without notice.

Data and Product protection

All documents, videos, content and communication through whatsapp and emails to the student are the property of YCA and cannot be shared to any third party.

Other Services

All other services stated or included in the training packages on the website for Deckhand and Stewardess Full STCW, Premium or Online we will provide as per the terms and conditions outlined above.

Applicable Law

Please not by using the services and agreeing to the terms and condition you accept the right for YCA to choose the jurisdiction for any dispute or settlement or in Hong Kong where the Company is registered.

Privacy Policy

Please refer to our Privacy Policy for information on how we collect, use and disclose information from our users. You acknowledge and agree that your use of the Services is subject to our Privacy Policy.

Limitations of Liability

By using the services, you fully agree to all terms and conditions outlined above and it is your personal responsibility to understand and read those terms before purchase and accepting them with the purchase or use of a service provided by YCA Media Consulting Limited.

You accept that you will not be eligible for any refund after purchase unless filling out the refund form or writing to [email protected] no later than 7 days of accessing the training.After 7 days of accessing the training and purchasing no refund will be gived under any circumstances to the student.

If using the payment plan option, we will only charge the student the deposit/first payment. No further charges will incur to you should you choose to cancel your selected training date.

For students using the payment plan option the first payment is deemed a deposit and it is nonrefundable.

If you are enrolled or complete any training through a selected third-party provider no refund can be given.

Any refund request To the extent permitted by law, we exclude all conditions, warranties, representations or other terms which may apply to our site or any content on it, whether express or implied.

We will not be liable to any user for any loss or damage, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, even if foreseeable, arising under or in connection with:

use of, or inability to use, our site; or
use of or reliance on any content displayed on our site.

YCA Media Consulting have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity. At time of Purchase you fully accept these terms and conditions, that refunds are not possible, and give us full rights and accept the choice of our training providers for your training and courses. ,
